Neutemeljena je pritožbena navedba, da je potrebno pravni standard očitne oziroma skrite napake v vsakem konkretnem primeru opredeliti z vidika osebnih lastnosti konkretnega posameznika. Očitne napake so namreč tiste, ki bi jih pri običajnem pregledu (ob prevzemu stvari) lahko opazil (ugotovil) skrben človek s povprečnim znanjem in izkušenostjo. Ni mogoče prisoditi denarnega zneska tako za manjvre (Slovenian)
