Pravno podlago tožbenega zahtevka predstavlja določba 155. člena OZ (odgovornost proizvajalca stvari z napako). Gre za objektivno odgovornost (odgovornost po načelu vzročnosti) proizvajalca stvari, ki da v promet stvar z napako. Izhajajoč iz citirane določbe 155. člena OZ je breme tožeče stranke kot oškodovanke, da zatrjuje in dokazuje dejstva, ki opredeljujejo zakonito domnevo o obstoju vzročne z (Slovenian)
