Sporno določilo distribucijske pogodbe, po kateri aktivnosti v zvezi z reklamiranjem dobavljenega izdelka izvaja tožnik, je treba razumeti tako, da je bilo potrebno soglasje toženca za posamezno akcijo. Drugačna razlaga (da je o tem lahko odločal sam tožnik) namreč ne ustreza temeljnemu načelu enakopravnosti udeležencev v obligacijskih razmerjih. I. Pritožbi se ugodi in se sodba sodišča prve stopn (Slovenian)
