Stranka, ki se z zavrnitvijo izvedbe dokaza ne strinja, mora to kršitev uveljaviti že v postopku pred sodiščem prve stopnje, v pritožbi pa mora substancirano navesti dejstva, zaradi katerih meni, da bi izvedba konkretnega dokaza lahko privedla do drugačne ugotovitve odločilnih dejstev oziroma drugačne rešitve spora.
