Tožniku je bila podana izredna odpoved pogodbe o zaposlitvi z očitkom hujše kršitve delovnih obveznosti, storjene iz hude malomarnosti v smislu določb druge alineje prvega odstavka 111. člena ZDR. Ker je v primeru izredne odpovedi pogodbe o zaposlitvi dokazno breme na strani stranke, ki podaja izredno odpoved (drugi odstavek 82. člena ZDR), v tem primeru torej sodišče ni zmotno uporabilo materialn (Slovenian)
