Naročnikov tožbeni zahtevek (ki ga postavi potem, ko prevzemnik ni hotel odpraviti napake) za plačilo stroškov, ki bodo potrebni za odpravo napake (tretji odstavek 620. člena ZOR), ima naravo jamčevalnega in ne odškodninskega zahtevka in zato zanj velja rok, predpisan za sodno aktivno uveljavljanje te naročnikove pravice (prvi odstavek 616. člena ZOR).
