Bistvo 122.a člena ZIL-1 je v tem, da lahko sodišče s sklepom naloži nasprotni stranki (kršitelju) predložitev dokaznih sredstev, ki so pri njej. S tem se eni stranki naloži razkritje dokaznih sredstev, do katerih bi sicer nasprotna stranka ne imela dostopa, če bi se uporabljale zgolj določbe ZPP.
