Odstop tožnikov od pogodbe ima učinek ex nunc, torej učinkuje za naprej. Tožnika namreč nista niti zatrjevala, da dozdajšnja izpolnitev pogodbe, torej deloma zgrajena hiša, zanju nima pomena. Glede opravljenih del je treba izhajati iz pogodbeno dogovorjene cene. I. Pritožbi se delno ugodi in se sodba sodišča prve stopnje: - v I. in III. točki izreka razveljavi in se v tem obsegu zadeva vrne sodišč (Slovenian)
