Kot izhaja iz obrazložitve izpodbijane sodbe, je sodišče pravdni stranki v tem postopku ponovno zaslišalo, vendar pa ju je zaslišalo le glede vprašanj, o katerih še nista bili zaslišani v postopku I Pg 7/2018. Navedeno postopanje sodišča prve stopnje je glede na določbo 219.a člena ZPP ustrezno, saj sta se stranki strinjali, da se uporabita zapisnika o zaslišanju pravdnih strank iz drugega postopk (Slovenian)
