Tožena stranka je namreč z omenjenim dopisom z dne 30.11.2007 pri tožniku ustvarila vtis, da bo v relevantnem delu napako prostovoljno odpravila, oz. da bo v določenem delu (v vrednosti 7.100,00 EUR) krila stroške za popravilo plošč. Zaradi tega se po oceni pritožbenega sodišča tožena stranka na pravilo o prekluzivnem roku iz prvega odstavka 635. člena OZ ne more sklicevati. Pritožba se zavrne in (Slovenian)
