Sodišče prve stopnje je pravilno ugotovilo, da je izdelek - vgrajena kolčna proteza Profemur-Z imela napako in da je do zloma prišlo zaradi neustreznega materiala. Kolčna proteza ni ustrezala varnemu izdelku, saj njegova varnost ni bila takšna, kot jo je tožnik upravičeno pričakoval. I. Pritožba se zavrne in se v izpodbijanih delih (I., III., IV. in V točki) potrdi sodba sodišča prve stopnje. II. (Slovenian)
