Dogovor (pogodba) ni edini relevantni kriterij za presojo, ali je podjemnik naročilo izpolnil pravilno. Kadar pogodbenika ne uredita vseh značilnosti posla s pogodbo, mora podjemnik posel opraviti tako, da ima ta običajne lastnosti. Merilo za presojo pravilnosti podjemnikovega ravnanja pa so v vsakem primeru tudi pravila stroke. Nerelevantno je zato pritožbeno sklicevanje na dogovorjene obveznosti (Slovenian)
